In a ruling by the deputy pensions ombudsman, Charlie Gordon,
pension scheme administrators have been made to compensate a
"missing member" after records of his contributions were lost
following the pension scheme winding up.
In 'M Tyler v Robert Fleming Benefit Consultants and Minet
Benefit Consultancy', Mr Gordon said that the member was an
innocent victim and should be put in the same position he would
have been if he had been included in the bulk transfer of benefits
when it happened.
Law firm Sackers claimed the case serves as a warning to pension
scheme administrators and trustees on the importance of maintaining
proper records.
